Charter Agreement & Waiver
A signed charter agreement is required before departure on every TPL yacht charter. Review each section carefully. Your TPL concierge will send a countersigned copy upon confirmation.
§ 1 — Liability Waiver & Release of Claims
By participating in a charter arranged by The Privileged Life ("TPL") in partnership with Bow to Stern Rentals, Pink Ocean Yachts, and/or Yacht Side Chick ("Operators"), all guests acknowledge and agree that:
- Marine activities carry inherent risks including, but not limited to, rough water, inclement weather, equipment failure, and physical injury. Guest assumes all such risks voluntarily.
- Guest, on behalf of themselves and any minor in their care, hereby releases, waives, and discharges TPL, Bow to Stern Rentals, Pink Ocean Yachts, Yacht Side Chick, and all affiliated crew members from any and all claims, demands, or causes of action arising from participation in the charter, whether caused by negligence or otherwise.
- This waiver is binding on guest's heirs, assigns, and legal representatives.
- Guest certifies they are physically fit to participate and are not aware of any medical condition that would make participation inadvisable without medical clearance.
§ 2 — Captain's Authority
The licensed captain has sole and final authority over all operational decisions, including:
- Route selection, operating area, and departure/return times.
- The decision to remain in port, return early, or alter course due to weather, sea conditions, mechanical issues, or safety concerns. No refund of unused charter time is owed when the captain exercises this authority due to safety concerns.
- Removal of any guest whose conduct threatens the safety or enjoyment of others. Removed guests forfeit their charter fees.
- All U.S. Coast Guard regulations, FWC rules, and applicable maritime law apply at all times.
§ 3 — Guest Conduct & Passenger Limits
- Maximum Capacity: Passenger limits are set per vessel and are non-negotiable. Exceeding capacity is a federal violation and will result in immediate termination of the charter without refund.
- Age: Guests under 18 must be accompanied by a parent or legal guardian who accepts full responsibility for the minor.
- Alcohol: Moderate personal consumption is permitted. The captain may refuse service or disembark any intoxicated guest. Alcohol is prohibited for guests under 21.
- Prohibited: Drugs, illegal substances, weapons, disruptive behavior, harassment of crew, or intentional property damage. Any of these results in immediate disembarkation and possible law enforcement contact.
- Life Jackets: Must be worn by all guests under 13 while underway. Life jackets are available for all passengers and must be put on when directed by the captain.
§ 4 — Damage Deposit & Liability for Damage
- A refundable damage deposit authorization hold may be required per the Operator's terms prior to departure.
- Guest is financially responsible for any damage to the vessel, equipment, or property caused by willful misconduct, negligence, or failure to follow crew instructions.
- Normal wear is excluded. Extraordinary cleaning costs (e.g., biological waste) will be charged against the deposit.
- Damage exceeding the deposit amount will be invoiced and is legally collectible. TPL reserves the right to pursue recovery of damages through all available legal means.
§ 5 — Cancellation & Weather Policy
- Guest Cancellation — 72+ hours before departure: Full refund of charter fee, less a $75 processing fee.
- Guest Cancellation — 48–72 hours before departure: 50% refund of charter fee.
- Guest Cancellation — under 48 hours before departure: No refund. Charter fee is forfeited.
- Weather or Operator Cancellation: If TPL or the Operator cancels due to unsafe weather or mechanical issues, guests receive a full credit toward a rescheduled charter or a full refund at the guest's election.
- Rescheduling: One free rescheduling is permitted with 72+ hours notice, subject to availability.
- Cancellation determinations due to weather are made by the licensed captain no later than 2 hours before scheduled departure, based on maritime safety standards.
§ 6 — Indemnification
Guest agrees to indemnify, defend, and hold harmless TPL, Bow to Stern Rentals, Pink Ocean Yachts, Yacht Side Chick, and their respective officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or related to:
- Guest's breach of this agreement;
- Guest's negligent or intentional acts or omissions during the charter;
- Injury to third parties caused by guests; or
- Damage to third-party property caused by guests.
§ 7 — Governing Law & Dispute Resolution
- This agreement is governed by the laws of the State of Florida and applicable federal maritime law.
- Any disputes shall first be subject to good-faith mediation. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade or Broward County, Florida.
- Guest waives the right to participate in a class action against TPL or Operators arising from charter activities.
- If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
